The long-running legal battle between former Indian cricket captain MS Dhoni and retired IPS officer G. Sampath Kumar has ignited again. The latter has approached the Madras High Court alleging special treatment.

The appeal, filed by Sampath Kumar, questions the August 11, 2025, order passed by a single judge that appointed an advocate commissioner to record Dhoni’s statement in a ₹100 crore defamation suit.

The former cop argued that all citizens must be treated equally before the law and that no special privileges should be given to celebrities, including the former Indian skipper.

A Division Bench comprising Justices S.M. Subramaniam and Mohammed Shaffiq agreed to hear the matter on November 4, 2025.

The Bench, however, directed Sampath Kumar’s counsel to first file an affidavit withdrawing certain highly offensive remarks allegedly made against the judiciary before proceeding with the hearing.

Just a day earlier, another bench headed by Justice Subramaniam, along with Justice M. Jothiraman, had dismissed Sampath Kumar’s earlier appeal against the court’s refusal to reject  MS Dhoni’s defamation suit.

Dhoni’s senior counsel, P.R. Raman, had successfully argued that the retired officer’s plea lacked substance and was simply an attempt to delay the proceedings.

Origins of the defamation suit

Sampath Kumar, who served as Superintendent of Police in the ‘Q’ Branch CID (Internal Security) back in 2013, claims that while investigating a fake passport racket, he uncovered a cricket betting syndicate linked to match-fixing during the IPL, involving MS Dhoni.

He says his findings led him to depose before the Justice Mudgal Committee, which was investigating the 2013 IPL betting and spot-fixing scandal.

However, things took a dramatic turn when a television sting operation featuring Kumar’s conversations on betting was aired in February 2014. Soon after, he was suspended for interacting with the media.

Following these events, a ₹100 crore defamation suit was filed by MS Dhoni in 2014 against Kumar for making baseless allegations that tarnished his reputation by linking his name with match-fixing.
