In an unfortunate turn of events, Indian all-rounder Hardik Pandya has announced separation from model-turned-actor wife Natasa Stankovic. After weeks of speculation, the duo shared a joint Instagram post to confirm the divorce.

Hardik Pandya and Natasa Stankovic got engaged in 2020 and were blessed with a son, Agastya. 

The couple later had a grand wedding ceremony in Udaipur in 2023. However, the couple grew apart due to irreconcilable differences. 

That being said, since the couple were married under Indian law, Natasa has rights over Hardik's property and overall net worth. 

On that note, let's explore some of the rights of divorced women in India.

Property Rights

Under the Indian law system, a divorced woman can stake claim on her share on properties jointly owned with her husband. In case of a man who has complete control over a property, the estranged wife can still ask for an allowance based on her needs.

However, to stake a claim on a property, the wife has to show proof of her contribution. A failure to do so can lead to loss of right over the said property. Still, she can reside in the property until the divorce proceedings are concluded.

Additionally, the wife's properties will solely remain hers, and she will have the free will to sell, gift or give it on lease as per her preference.

Maintenance Rights

Under second 125 of Indian penal code, a wife can claim maintenance for her and her child in case of separation or a divorce. Those maintenance rights are further divided into two categories.

  • Interim Maintenance

An estranged wife can seek monetary maintenance from her spouse during the period of divorce proceedings. She can claim it from the date of the case filing until the divorce is granted in the court of law.

  • Permanent Maintenance

An estranged wife can claim either lump sum or monthly alimonaypayment from her husband as maintenance under Section 25 of the Hindu Adoption and Maintenance Act 1956.

The alimony amount will be determined by the court of law after considering various factors, such as the couple's status, financial position, the duration of the marriage, number of children involved and many more.

Notably, even a working woman has the right to claim alimony if the disparity in her and her spouse's income is huge.
