In a significant development, Mohammed Shami suffered a legal blow on Tuesday as the Calcutta High Court ordered him to pay ₹4 lakh per month in interim maintenance to his ex- wife Hasin Jahan and their daughter. The order comes after Jahan challenged a previous district court ruling that awarded her ₹50,000 and her daughter ₹80,000 per month in 2023.
Delivering the revised ruling, Justice Ajoy Kumar Mukherjee directed Shami to pay ₹1.5 lakh to his wife and ₹2.5 lakh to his daughter every month, stating that the earlier amount was inadequate considering the lifestyle the petitioners were used to during the marriage and the current financial capacity of the cricketer.
“In my considered opinion, a sum of ₹1,50,000 per month to the petitioner no.1 (wife) and ₹2,50,000 to her daughter would be just fair and reasonable to ensure financial stability for both the petitioners, till the disposal of the main application,” the court observed in its order.
Court Cites Shami’s Substantial Income
Justice Mukherjee said the court had taken into account Mohammed Shami’s earnings, financial disclosures, and the precedents laid down in previous judgments relating to alimony and maintenance. He further noted that Hasin Jahan had remained unmarried and was living independently with the child, which entitled her to financial support in line with her marital standard of living.
“The petitioner’s wife is entitled to a levelled maintenance that she enjoyed during her continuance of marriage and which reasonably secures her future as well as the future of the child,” the court noted.
The court clarified that while ₹4 lakh would serve as monthly maintenance, Shami is also free to voluntarily contribute to any additional educational or other expenses for his daughter beyond the specified amount.
Legal Battle Since 2018
The legal dispute between Mohammed Shami and Hasin Jahan that began in 2018. The couple, who married in April 2014, faced a breakdown in their relationship four years later when Jahan lodged FIR against the cricketer and his family at the Jadavpur police station.
The FIR included serious accusations under Section 12 of the Protection of Women from Domestic Violence Act, 2005, citing physical and mental abuse, dowry harassment, and neglect of their child.
With the court’s latest order, Mohammed Shami legally is bound to pay ₹4 lakh per month in maintenance unless the decision is revised in future proceedings or after the final disposal of the main application.
